1. Seller
YachtsNorway, Stranden 32, 0250 Oslo, Norway. Contact: post@yachtsnorway.no. The company registration number appears on the invoice.
2. When the agreement is formed
A request is not a booking and commits you to nothing. The agreement is formed only once you have accepted a written offer from us, either by pressing "Accept and book" on your own page, or by confirming in writing by email.
Offers are valid for the period stated in the offer, normally 72 hours. After that the offer lapses automatically and the boat may be chartered to someone else.
3. Prices
Prices are quoted excluding value added tax unless stated otherwise. VAT is added at the applicable rate.
The price in the offer is fixed for what is described there. Extras you order along the way, additional hours, catering, extra crew, are invoiced in addition, as agreed.
4. Payment
We invoice after the charter has taken place, unless otherwise agreed in writing. Payment terms are 10 days. Late payment attracts interest under the Norwegian Late Payment Interest Act.
For high-value bookings, or bookings made far in advance, we may ask for a part payment or a guarantee before the charter. Where that applies, it is agreed in writing beforehand.
5. Cancellation
Cancellations must be made in writing. The time we receive the notice is what counts.
- More than 30 days before departure: free of charge.
- 30 to 14 days before departure: 50 % of the agreed price is invoiced.
- Less than 14 days before departure: the full agreed price is invoiced.
Costs already incurred for catering or other extras ordered from third parties are added where they cannot be cancelled.
If we cancel for reasons other than safety, you pay nothing, and any amount already paid is refunded in full.
6. Changes
If you want to move the charter to another date, we will try to make it work. Where the boat is free and you tell us more than 14 days before departure, we do it without a fee. Closer to departure it depends on whether we manage to charter the original slot to someone else.
7. Right of withdrawal
Norwegian consumer law normally gives consumers a 14-day right of withdrawal for agreements concluded away from business premises. That right does not apply to agreements for leisure activities where we undertake to provide the service on a specific date or within a specific period, under section 22(m) of the Norwegian Right of Withdrawal Act.
Because a yacht charter is booked for a specific date, the cancellation rules in clause 5 apply instead of a right of withdrawal. This is drawn expressly to your attention before you accept the offer.
8. Delay and defects
If the charter is substantially delayed, or substantially shorter than agreed, for reasons within our control, you are entitled to a proportionate reduction in price. In the event of material breach on our part you may cancel the agreement and have your money back.
We are not liable for losses caused by circumstances outside our control, such as extreme weather, breakdown, industrial action or official orders.
9. Personal data
The details you give us are used only to handle your request and carry out the charter. See our privacy policy for how long we keep data, who sees it, and what rights you have.
10. Disputes
The agreement is governed by Norwegian law. We hope to settle any disagreement amicably. Consumers may bring the matter before the Norwegian Consumer Authority. The legal venue is Oslo District Court unless mandatory law provides otherwise.
